1. Terms and Conditions
1.1. Terms and Conditions for the engagement of Pawfect Pets Christchurch in effect from 21st January 2024.
2. Privacy is Important to Us
2.1. Pawfect Pets Christchurch is committed to protecting your privacy, and we abide by New Zealand's Privacy Act. Personal information is provided by you to Pawfect Pets to enable us to provide you and your pets with personalised pet care.
3. General
3.1. Below are the Terms & Conditions to represent the terms by which Pawfect Pets Christchurch will undertake work.
4. Services
4.1. Pawfect Pets Christchurch agrees to provide the services specified in the booking form or as organised subsequently.
4.2. Services provided will be carried out in accordance with the requirements of the Client and agreed by Pawfect Pets Christchurch, as identified on the original meeting, or as agreed between the Client and Pawfect Pets Christchurch in writing, but subject to clause 5.3 below.
4.3. All walks are on or off lead depending on recall.
4.4. If Pawfect Pets Christchurch is unable, for any reason, to complete or execute the services agreed, then Pawfect Pets Christchurch may opt to provide a suitable substitute and will consult with the Client where possible.
4.5. Pawfect Pets provides services for walking of pets and house sitting.
5. Health and Safety
5.1. The Client warrants that their pet(s) are in good health at all times. Pawfect Pets Christchurch will take care to ensure the ongoing health and safety of the Clients pet(s), but the Client accepts that there are times when their pet(s) may become sick, ill or even injured through no fault of Pawfect Pets Christchurch. The Client accepts this and indemnifies Pawfect Pets Christchurch against any cost and/or damages that result from any sickness, illness or injury that occurs during or results from Pawfect Pets Christchurch performance of the contracted services.
5.1 Where a client’s dog (or dogs) cause injury to another animal during a walk, the Client agrees to cover any and all veterinary costs (without reservation or limitation and including ongoing care)
5.2 The Client agrees to be responsible for ensuring that the work environs of Pawfect Pets are compliant with the requirements of the Health and Safety in Employment Act 1992.
5.3 The Client will indemnify Pawfect Pets for and against all liabilities arising out of or in connection with any loss, cost, damage or injury caused directly or indirectly by the performance of the Pawfect Pets Christchurch. Obligations provided such loss, cost, damage or injury are not caused or contributed to by any act, default or negligence on the part of Pawfect Pets Christchurch or their representative. The indemnity should include and extend to all costs and expenses incurred by Pawfect Pets Christchurch during investigating or defending any claim.
6. Charges and Payment
6.1. All prices and charges are expressed in New Zealand Dollars and are GST inclusive.
6.2. The Client shall pay Pawfect Pets Christchurch for all services performed in accordance with services to be provided as per clause 5.1 of this agreement.
6.4 All payments of services are to be paid at the end of the week unless you have a concession
(a)When a booking is cancelled, Pawfect Pets Christchurch reserves the right to apply the following charges:
(b)Where cancellation occurs on the day of the service or where no notice is given for whatever reason, a cancellation fee of 5% of the total booking may be charged. Discretion can be considered however by Pawfect Pets Christchurch. For house sitting, 50% deposit is to be made at the time of the booking with Pawfect Pets Christchurch. The remainder is to be paid after the job is complete. If cancelled 7 days before the house sitting starts, the deposit will be refunded. However, if it is cancelled 48 or 24 hours before, then 20% of the deposit will be kept and the rest refunded. This is to ensure that clients don't miss out on bookings.
7. Insurances, loss and damage
7.1. The responsibility of ensuring property, contents and any pets are adequately insured, whilst Pawfect Pets Christchurch provides its services, is the responsibility of the Client. The Client agrees to cover any insurance excess that may be due and to indemnify Pawfect Pets Christchurch for any and all liability for losses incurred by Pawfect Pets Christchurch, the Client or third parties.
7.2. Where Pawfect Pets Christchurch accepts control of key/codes to a clients’ house, Pawfect Pets Christchurch will take all care in ensuring the ongoing security of those keys whilst they are in Pawfect Pets Christchurch care. Pawfect Pets Christchurch will take all care to ensure that the door used to gain access to the Clients’ house, in the performance of the duties they have been engaged to carry out, is locked on leaving. Pawfect Pets Christchurch does not accept liability for the security of other doors/windows which might have been left unsecured by parties other than Pawfect Pets Christchurch. All keys/codes retained by Pawfect Pets will be stored with no identification of address.
7.3. The Client acknowledges that even with the best of care, accidents and illness can occur with pets, and therefore release Pawfect Pets from liability should this
occur whilst the pet is in a Pawfect Pets Christchurch care.
7.4 If the Pawfect Petsfails to commence or complete the services promptly and efficiently and as a result the Client incurs loss or damage then Pawfect Pets Christchurch shall be liable for such proportion of loss or damage as is attributable to the service failure.
8. Miscellaneous
8.1. The Client will provide all food and other supplies necessary for the full care of their pet. Any food or veterinary expenses incurred by the Pawfect Pets Christchurch during the course of the assignment must be reimbursed by the Client.
8.2. Where Pawfect Pets Christchurch is unable to contact the Client directly for advice on veterinary care, Pawfect Pets Christchurch will make all decisions based on the furtherance of the life of the pet in question. All costs associated will be borne by the Client without limit. Where the Client wishes to limit veterinary care, this must be noted expressly on the Client Registration form and signed.
8.3. Pawfect Pets Christchurch will endeavour to fulfil the contracted services, but where extremes of weather make this impractical or unsafe, or other unforeseen events occur which make completion of the service impractical or unsafe, Pawfect Pets reserves the right to postpone the service until the next day when the service will not be impacted. Pawfect Pets will contact the Client to explain what has happened and discuss what options suit both parties. In these situations, the Client recognises that there will be no refund. In any other situation where the walk has ended early, Pawfect Pets will discuss with the Client what happened and offer the Client later additional time in proportion to the lost time, at no cost to the Client. Where discussion with the Client is impractical or not possible, Pawfect Pets Christchurch will take steps to extend future walks so that previous lost time will be made up and the Client will not suffer a loss.
9. Acceptance Procedure
9.1. The standard method of engaging Pawfect Pets Christchurch is through the signing of Pawfect Pets Client Registration Form. Where no signature has been provided, the performance of duties as requested by the Client will be considered acceptance of these terms in their entirety and without limit.
9.2 Pawfect Pets Christchurch will promise to love, adore and spoil the pet whilst under their care as if they were my own.
